Signatures on court documents

Documents including affidavits, financial statements and consent orders may be signed electronically by the person swearing or affirming the document and/or their lawyer including by having the person signing the document type their name in the relevant space in the signature block instead of signing the document.

The Courts will accept for filing affidavits and financial statements that have been signed without a qualified witness also signing the document subject to, if required by the judicial offer, the person swearing or affirming the document being made available by telephone or videoconferencing or in person at a subsequent court event to swear or affirm that the contents of the document are true and correct to the best of their knowledge information and belief.

All documents are now to be e-filed online where availability. For documents that are not able to be filed via the Commonwealth Courts Portal, they may be emailed to Registry for electronic filing.
