Taline Chater

Taline has over 20 years’ experience in corporate distress situations, restructurings and insolvency and complex commercial disputes.

She brings particular expertise in both informal and formal turnaround, debt restructuring and insolvency situations, advising various stakeholders including debtors and creditors in the mining and resources, retail, construction and property sectors. She is also known for achieving strategic settlements in complex corporate disputes as well as managing litigations to hearing, where appropriate.

She brings a high level of integrity and dedication to her role. She provides clear and strategic advice and a cultivated understanding of the various industry sectors in respect of which she advises. Taline is known for being a ‘big picture’, strategic and agile thinker.

Taline has advised ASX listed and private companies, and funds across the financial services, property management, construction and infrastructure, mining, education, retail, media and technology sectors. Taline has also completed strategic secondments at the Australian Securities and Investments Commission, Lendlease and Amp Capital.

Expertise

Taline’s expertise includes:

  • Distressed debt and corporate financial restructurings either borrower or financier side
  • Formal insolvency including voluntary administrations, deed of company arrangements receiverships, schemes of arrangement and liquidations, either insolvency practitioner’s side or creditor side
  • Complex security enforcement advice including in respect of the Personal Property Securities Act (Cth)
  • Commercial disputes, including urgent injunctions or freezing order applications, commercial settlements and mediations
  • Regulatory investigations and advice particularly actions taken by ASIC against directors, financial services providers

Recent Projects

  • Acting for the ultimate foreign shareholder of a group of companies in respect of a large and complex distressed Cook Colliery Australian mine.
  • Acting for the board members of the Career Australia Group in complex, multi party insolvent trading and breach of officers’ duties proceedings in the Federal Court of Australia.
  • Advising the Administrators on the two respective restructures of the Cockatoo Coal group and the companies’ boards following the restructures of the Australian mining operations.
  • Acting for ANZ in respect of various complex, unsecured and secured debt exposures in the professional services and hospitality sectors.
  • Advising the shareholder and financier of the Oroton Group in connection with the voluntary administration of the group and its ultimate restructure proposal.
  • Acting for CBA in respect of the restructuring of a significant debt owed by the PR Finance group in the context of a scheme of arrangement and subsequent voluntary administration and liquidation.
  • Acting for the Australian Taxation Office in respect of a test case which involved taking an assignment of the liquidator’s causes of action and subsequently commencing proceedings in the Supreme Court of NSW against the director and shadow director of a corporate group for breach of officers’ duties.
  • Advising the purchaser in respect of strongly contested proceedings in Supreme Court of Qld in relation to a Share Sale Agreement.
  • Advising an overseas party in respect of its dispute in the Supreme Court of NSW against a global education provider in relation to a licence agreement.
  • Advising the Administrators and Liquidators of the Dick Smith group on all aspects of the insolvency.
