Kate Marginson

Kate specialises in all aspects of the development approval process. Kate advises a broad range of private and publicly listed property developers and commercial land holders on the development process and the most efficient way to navigate the NSW planning system including written advice, and often, in the Land and Environment Court.

Kate embodies a practical and outcome-based approach to legal issues and ability to negotiate the approval process with local and state government authorities through the Land and Environment Court.

Kate’s expertise includes:

  • Appeals to the Land and Environment Court in relation to development applications for a broad range of uses
  • Representing landowners in relation to Council Orders and prosecutions
  • Land use and property development – acting for developers, landowners, property investors, hoteliers, community associations, individuals and consultants

Recent projects

  • Appearing in the Land and Environment Court in Class 1 merit appeals and Class 4 prosecution proceedings relating to tower development in Central Sydney, residential flat buildings, mixed use developments, Greenfield subdivision, aged care facilities, single dwellings, shop top housing developments and places of public worship.
