Shaun practices exclusively in insurance litigation across all areas of insurance law and his principal areas of expertise are workers’ compensation and employers indemnity, public liability, professional indemnity and motor recovery claims.

Shaun advises insurer and self insured clients along with other large employers on all aspects of insurance related claims. Shaun’s experience in alternate dispute resolution pathways including mediation and negotiation enable him to consistently negotiate settlements within the client’s expectations. Shaun is also cognizant of individual client circumstances and always takes a commercially sound approach to claims management.

While early resolution of claims if appropriate is always pursued, Shaun also has extensive experience in litigated matters including WorkCover Arbitration Hearings along with Trials in the Magistrates, District and Supreme Courts of Western Australia and Appeals in the Court of Appeal.

Recent Matters

  • Acting in numerous claims involving worker’s claiming to have developed a psychiatric injury encompassing claims ranging from alleged bullying to those resulting from serious assaults or involvement in traumatic events
  • Advising a client on a matter where a worker was injured on a mine site on their day off and whether the injury was sustained “in the course of the employment”
  • Advising clients in relation to claims related to toxic or other industrial exposures and noise induced hearing loss.
  • Acting for an insurer in a property damage liability claim involving multiple parties arising out a single vehicle accident involving a prime mover.
  • Acting for an insurer in a property damage dispute arising from a residential fire. The client was the insurer of the manufacturer of the air conditioning unit installed in the premises, which the Plaintiffs claim malfunctioned and caused the fire that damaged the property
  • Acting for an insurer in product liability claim involving the insured’s plumbing fitting products that had been used in renovation works completed on an aged care facility.
