Cindy is a Special Counsel in our Adelaide Insurance team with over 25 years’ experience in insurance litigation.  Her current focus is on medical negligence defence cases and general insurance claims, building on a strong foundation in statutory compensation schemes (CTP and workers compensation).

Cindy manages claims from start to finish, from early advice on indemnity and coverage, guiding clients through the Coronial processes, managing Pre-Action procedures, litigation, and resolution via negotiation, mediation or trial and appeal.

She is known for delivering clear, comprehensive, fit-for purpose advice that aligns with each client’s business objectives and claims strategy.

Cindy is a strong believer in the value of relationships with clients, counsel, opposing lawyers, investigators, medical professionals and all stakeholders in the insurance practice. She understands the role these relationships have in achieving the best outcomes.  Her practical, communicative approach and industry knowledge have made her a trusted advisor to her clients.

Recent Matters

  • Defended medical negligence claims on behalf of a radiological imaging company and hospitals for claims inclusive of late diagnosis of cancers, infection from administration of contrast dyes, nerve injury from insertion of an intravenous cannula, incorrect reporting of imaging, injuries arising from birth, improper/no informed consent cases, and a case of penile injury following insertion of a catheter in a paraplegic patient.
  • Represented various health care and disability care organisations in Coronial Inquests and investigations into deaths in care.
  • Managed a late notified claim for serious injuries arising from a ski boat accident also involving a claim by the claimant’s employer seeking pro quod servitium amisit damages.
  • Defended a claim by a journalist passenger on a vessel in the pre-dawn hours during a yacht race when the vessel was driven into an obstacle.
  • Defended nervous shock and loss of dependency claims following the death of a drag racer in a drag race involving also issues of waiver of indemnity and obvious risk.
  • Managed a public liability claim for a labour hire contractor’s employee involving recovery sought by RTWSA and the complexities of a common law claim where the claimant is a “seriously injured worker” under South Australian workers compensation legislation.
  • Advised on a potentially fraudulent claim for indemnity arising from a suspected deliberately lit shop fire culminating in successful denial of indemnity.
  • Defended a professional indemnity claim from an architect with respect to his advice on and oversight of the construction of a farm barn’s roof structure.
