  • Commercial litigation and alternative disputes resolution, with expertise in corporations law, trusts, funds management, contract, mining and auditor negligence
  • Corporate insolvency and restructuring in industries including property development, retail, mining, airlines, construction and manufacturing
  • Property and leasing disputes including in major residential property development, shopping centres, industrial and commercial
  • Inquiries, Commissions and major investigations.

Recent Matters

  • Successfully defending former director of Dixon Advisory and Superannuation Services in Federal Court proceedings brought by ASIC seeking civil penalties and banning orders for breaches of directors’ duties
  • Acting for Bensons Property Group Pty Ltd (circ $1bil creditors) in its restructure leading to voluntary administration (Dec 24 – Feb 25), Deed of Company Arrangement and Creditors Trust. This process represented the end of a significant four-year restructuring programme which included acting as safe harbour advisers
  • Acting for the Director of Consumer Affairs Victoria in Supreme Court proceedings (31 defendants) recovery retirement village land pursuant to a statutory charge. The matter also involved a removal and remittal application to the High Court due to jurisdictional issues
  • Acting for the special purpose liquidators of Pluton Resources Pty Ltd (in liq). Actions included application of the appointment of the special purpose liquidator, significant insolvent trading litigation, various remuneration applications and a successful application for the replacement of the liquidator with the special purpose liquidator
  • One of three partners in the team of Solicitors assisting in the Royal Commission into the Management of Police Informants. Focus of the role was liaising with Victoria Police on information gathering and various applications for suppression orders
  • Supreme Court Vic litigation (and successful resolution) against the auditors of a listed entity in circumstances where the auditors lodged a Disclaimer of Opinion resulting in a temporary suspension of the company shares and delay in the ability to obtain funding for a plant construction project
  • Regular advice to major REITs on retail leasing legislation, leasing disputes, development risk and compliance, insolvency, land tax and rating disputes.
