Claims and investigations against medical practitioners by regulatory bodies including cross- jurisdictional claims and disciplinary proceedings in SACAT
Investigating a claim where it is alleged a surgical procedure resulted in kidney loss and multiple corrective surgeries
Advising in civil claims against medical practitioners, and private and public hospitals
Delayed diagnosis claim resulting in reduced life expectancy where medical practitioner failed to identify a cancerous mass visible in radiology performed for the different purpose of a shoulder injury
Advising on the legislative requirements for insurance in respect of e-scooter use in South Australia and in particular whether the obligation falls to a private insurer, or under the Nominal Defendant scheme
Acting in a series of complex personal injury claims arising out of mining incidents in both Western Australia and South Australia. The claims involved multiple parties and their insurers and included advising on complex contractual indemnity and dual insurance issues and advising underwriters as to the potential operation of s54 of the Insurance Contracts Act
Advising a strata insurer on their potential exposure for a paraplegic claim in circumstances where there is an argument regarding whether the injury occurred on common property, and whether the injured claimant had the requisite authority from the Strata Corporation to be performing work under the Strata Titles Act
Acting in a claim for pure mental harm against the foreign and local manufacturers of a crane when the boom of the crane sheared and failed which included considerations of liability under the Australian Consumer Law
Acting in respect of a claim for pure mental harm against the host employer of a worker who was allegedly harassed and physically assaulted by co-workers in the workplace over an extended period of time. This included advising on time limitation issues under the Limitations of Actions Act.
