Alistair’s expertise includes:

  • Judicial review proceedings before the Federal Court of Australia, including significant experience regarding decisions under the Customs Act 1901
  • Australian sanctions law, including legal advice regarding scope, application and compliance with Australian sanctions laws, authoring sanctions compliance policies and applications for permits before the Australian Sanctions Office in the Department of Foreign Affairs and Trade
  • Australian export controls, including legal advice regarding control status of goods and technology (including aviation, space, quantum computing, SAAS, encryption, advanced computing, hybrid materials), export control compliance, permit applications with Defence Export Controls and representation concerning policy development
  • Customs and cross-border regulatory, including tariff classification, country of origin, export and import licensing regulations, and biosecurity
  • Anti-dumping, countervailing and safeguards investigations, including representation of clients in over 90 anti-dumping and countervailing proceedings and 35 merits review proceedings
  • Broad administrative law experience, including freedom of information applications and appeals, statutory interpretation
  • Treaty advisory and international trade disputes.

Recent Matters

  • Secured the removal of anti-dumping tariffs on imports of ammonium nitrate from Sweden
  • Settled five judicial review proceedings concerning decisions made under the Customs Act 1901 in his clients’ favour
  • Secured numerous export control permits and/or confirmation that no controls apply for members of the SAAS, aviation, automated vehicle and quantum computing industries
  • Advice regarding the scope and application of Australian export controls on re-exports of NVIDIA GPUs
  • Advice to major oil industry participant regarding scope, application and compliance with Australian sanctions regimes
  • Representation of importers, exporters and government bodies in over 90 anti-dumping proceedings and 35 merits review proceedings.
