Kate has practiced almost exclusively in the area of workplace relations and employment law since leaving a previous career in education and forging a new career in law. Working across all aspects of workplace relations and employment law, Kate specialises in helping clients traverse and navigate the complexities of the Fair Work Act 2009 (Cth) and the constantly evolving employment landscape. She provides clients with legal expertise in relation to all aspects of employment law arising under common law, state workplace laws, the Fair Work reforms and Australia’s safety net systems (including compliance with the National Employment Standards and the modern awards).
Kate has assisted in and conducted employment law litigation matters arising out of: Fair Work Ombudsman prosecutions; sexual harassment claims; adverse action claims; unfair dismissal applications; denial of contractual benefit claims; breaches of contract and modern awards; racial discrimination and victimisation allegations; and enforcement of statutory entitlements corresponding to safety net contractual entitlements.
She has worked closely with Human Resource practitioners and business-owners in: preparing strategies for organisational change; developing and implementing workplace policies and procedures including performance management processes; conducting workplace audits and investigations; developing detailed implementation strategies for enterprise agreements; and drafting employment agreements, enterprise agreements, individual flexibility agreements, independent contractor agreements, consultancy agreements and confidentiality agreements.
As a passionate educator, Kate has conducted workshops and provides appropriate training to line managers in relation to workplace behaviour, conducting workplace investigations, performance management and restructuring and redundancy.
Kate is also a registered Accredited Mediator with LEADR and the National Institute of Arbitrators and Mediators.
