Darren is a partner in our Melbourne office. He is a leading commercial litigation lawyer with over 18 years of experience providing advice and representation to leading ASX listed and multinational companies, governments and high net worth individuals in commercially significant, high profile and often multi-jurisdiction matters that require strategic analysis.
Darren has particular expertise in class actions and representative proceedings, complex commercial proceedings and arbitrations. He has assisted clients across multiple jurisdictions including South East Asia, Europe, North America and Africa.
Darren draws upon the depth of his experience and expertise to help clients to achieve their commercial objectives and manage risks in a cost effective and timely way when faced with the wide range of legal, commercial, insurance and brand issues associated with significant disputes, investigations and crises.
Recent examples of Darren’s work includes:
- Acting for the Liquidators of Timbercorp Finance in a class action brought by over 12,000 investors and borrowers seeking to avoid their investments in 33 agri-business managed investment schemes between 1992 and 2008, and loans entered into to fund those investments totalling in excess of $477m. All claims by the investors were dismissed following a complex trial. An appeal brought by the investors also failed on all grounds, as did an application to the High Court of Australia for special leave to appeal. Darren is now assisting the Liquidators to recover monies owed by investors under their loans with Timbercorp Finance.
- Acting for an ASX listed power company against Victorian emergency services and fire fighting organisations in the largest class actions in Australian history arising out of the Black Saturday Kilmore East and Murrindindi bushfires. These claims were resolved before judgment with the agencies collectively contributing $103.6m and $29.1m towards the resolution of those actions.
- Acting, with Indonesian Advocates, for an ASX listed oil and gas producer in relation to a representative proceeding brought by an environmental interest organisation in the Indonesian courts arising out of the Sidoarjo mudflow that erupted near an oil exploration well following an earthquake in East Java. All of the claims made against Darren’s client were dismissed by the Indonesian District Court, the Indonesian High Court and the Indonesian Supreme Court.
Darren has a Master of Laws and is a Fellow of the Australian Centre for International Commercial Arbitration (ACICA).
Darren is listed as a Recommended Leading Commercial Litigation & Dispute Resolution Lawyer in 2017 Doyle’s Guide 2017. Darren was nominated as a finalist for Partner of the Year at the Lawyers Weekly Australian Law Awards 2016.
